These Terms and Conditions apply to purchases made through www.thedragonoak.com and to the use of our website. They are intended to provide clear information about your rights and obligations when purchasing from The Dragon Oak.

By placing an order, you agree to these Terms and Conditions. Nothing in these Terms limits any mandatory consumer rights granted by applicable Belgian or European Union law.

2. Products

2.1 Handmade and Natural Products

Many products sold by The Dragon Oak are handmade, created in small batches or contain natural materials.

Crystals, stones, herbs, botanicals, handmade preparations and other natural materials may show variations in colour, shape, size, texture, pattern, inclusions or appearance.

These natural and handmade variations are part of the nature of the product and are not considered defects.

Product photographs are intended to represent the item as accurately as reasonably possible. Colours may vary slightly depending on lighting, photography and screen settings.

2.2 Spiritual and Metaphysical Products

The Dragon Oak offers products inspired by spiritual practices, symbolism, mythology, folklore and ritual traditions.

Any spiritual, energetic or metaphysical descriptions are provided for symbolic, traditional and informational purposes. Individual experiences may vary and no specific spiritual, energetic or magical result is guaranteed.

Our products and the information provided on our website are not intended to diagnose, treat, cure or prevent any medical or psychological condition and do not replace professional medical, psychological, legal or other qualified advice.

2.3 Ritual Oils and Preparations

Unless expressly indicated otherwise on the individual product page, ritual oils, spell oils, ritual waters, sprays, herbal preparations and similar products are created for ritual, symbolic or spiritual use.

They are not medicines.

Products must not be ingested unless a product is specifically and legally marketed for consumption.

Products should only be used according to the instructions provided with the product or on its product page.

Keep ritual products, herbs, oils and small objects away from children and pets where appropriate.

2.4 Jewelry

Jewelry should be handled and stored with reasonable care.

Exposure to water, perfume, cosmetics, chemicals, moisture or unsuitable storage conditions may affect certain metals, finishes, stones or components.

Normal wear or damage resulting from inappropriate use or lack of reasonable care is not considered a conformity defect. This does not affect the customer's statutory rights where a product was defective or non-conforming at delivery.

3. Orders

After placing an order, you will receive an electronic order confirmation containing the details of your purchase.

Please check your order details carefully and contact us as soon as possible if you notice an error.

The Dragon Oak may refuse or cancel an order for legitimate reasons, including payment failure, suspected fraud, stock errors, obvious pricing errors, legal restrictions or inability to ship the product to the selected destination.

If an order that has already been paid is cancelled by The Dragon Oak, the amount concerned will be refunded.

4. Prices and Payment

Prices displayed to consumers are final consumer prices and include VAT.

Shipping costs and any other applicable charges are displayed before the customer confirms the order.

For destinations outside the European Union, local import VAT, customs duties, brokerage charges or other import fees may be imposed by the destination country. Unless expressly stated otherwise, these charges are not collected by The Dragon Oak and remain the responsibility of the recipient.

Payment must be completed using one of the payment methods available during checkout.

The price applicable to an order is the price displayed when the order is confirmed.

5. Processing, Pre-orders and Mystery Boxes

Standard orders are generally processed within 5 to 10 business days before dispatch.

Custom-made products, pre-orders and Mystery Boxes may require up to 20 business days before dispatch, unless another dispatch date or processing period is clearly stated on the relevant product page.

Where a product page specifies a particular release date, pre-order shipping date or longer creation period, the information on that product page applies to that product.

Processing time and carrier delivery time are separate periods.

6. Shipping and Delivery

The Dragon Oak ships from Belgium to destinations made available during checkout.

Available countries, carriers, delivery services and shipping rates may change depending on carrier availability, customs requirements, legal obligations or other operational circumstances.

Estimated carrier transit times are provided for guidance and are not guaranteed. Delays may occur due to customs procedures, carrier disruptions, holidays, weather conditions or circumstances outside our reasonable control.

Where The Dragon Oak arranges the transport using a shipping option offered by us, the risk of loss or damage remains with The Dragon Oak until the customer, or a third party designated by the customer other than the carrier, physically receives the goods.

If the customer independently appoints a carrier that was not offered by The Dragon Oak, the risk may transfer in accordance with applicable law when the goods are handed to that carrier.

Shipping insurance or enhanced carrier services may provide additional tracking or claims options. Choosing an economy or non-insured shipping service does not remove statutory consumer rights.

7. Shipping Address

Customers are responsible for providing a complete and accurate delivery address.

Please contact us immediately if an address needs to be corrected.

If a parcel is returned because the customer supplied an incorrect or incomplete address, reasonable additional shipping costs may be charged before the parcel is sent again, provided the error was not caused by The Dragon Oak.

8. Right of Withdrawal

Consumers purchasing online generally have a statutory right to withdraw from their purchase without giving a reason.

For physical goods, the withdrawal period is 14 calendar days from the day on which the customer, or a third party designated by the customer other than the carrier, physically receives the goods.

Where several goods from one order are delivered separately, the statutory period is calculated in accordance with applicable consumer law.

To exercise the right of withdrawal, the customer must notify The Dragon Oak before the withdrawal period expires.

This may be done through:

or another clear statement communicating the decision to withdraw, including by email to info@thedragonoak.com.

After notifying us of the withdrawal, the goods must be returned within 14 calendar days.

9. Condition of Returned Goods

Customers may inspect products in the same way that they reasonably could in a physical shop.

Returned goods should be handled only to the extent necessary to establish their nature, characteristics and functioning.

The customer may be responsible for any diminished value resulting from handling beyond what is necessary for this purpose, where permitted by law.

Where possible, products should be returned safely packaged together with their original packaging and accessories.

10. Return Shipping Costs

Unless the product is defective, incorrect or The Dragon Oak has expressly agreed otherwise, the customer is responsible for the direct cost of returning goods following a statutory withdrawal.

Customers are advised to use an appropriate and traceable return method.

11. Refunds Following Withdrawal

When a valid statutory withdrawal is exercised, The Dragon Oak will reimburse payments received from the customer in accordance with applicable consumer law.

Where required by law, this includes the cost of the least expensive standard delivery option offered for the original order.

Additional costs resulting from the customer's choice of a more expensive delivery method are not required to be reimbursed.

Refunds are made using the same payment method used for the original transaction unless the customer expressly agrees to another method.

The Dragon Oak may withhold reimbursement until the returned goods have been received or until the customer provides evidence that the goods have been sent back, whichever occurs first.

12. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply, or may be lost, in situations provided by applicable law.

Relevant examples may include:

Goods made according to the customer's specifications or clearly personalised for that customer.

Sealed goods which are not suitable for return for health protection or hygiene reasons once the seal has been broken after delivery.

Goods which, after delivery, have become inseparably mixed with other products.

Digital content supplied without a physical medium where delivery has begun after the customer has expressly requested immediate access and expressly acknowledged that this causes the loss of the statutory right of withdrawal.

Any applicable exclusion will be interpreted in accordance with mandatory consumer law.

A product is not automatically excluded from statutory withdrawal merely because it was sold as a pre-order or as part of a Mystery Box.

13. Digital Products

Certain products may be supplied digitally.

Where digital content is made available immediately after purchase, the customer may be asked during checkout to expressly consent to immediate delivery and to acknowledge that the statutory right of withdrawal is lost once delivery of the digital content begins.

Where the legally required consent or acknowledgement has not been obtained, the customer's statutory rights remain unaffected.

14. Voluntary Order Cancellation

As an additional service, customers may contact us within 24 hours after placing an order to request cancellation before processing.

We will make reasonable efforts to accommodate the request.

An order that has already entered preparation or has been dispatched may no longer be cancellable under this voluntary cancellation policy.

This voluntary cancellation policy is separate from, and does not limit, the statutory right of withdrawal.

15. Lost, Damaged or Incorrect Orders

Every order is packed with care.

If an order arrives damaged, incomplete or incorrect, please contact info@thedragonoak.com as soon as reasonably possible and include the order number and, where useful, photographs of the parcel and product.

For efficient investigation with a carrier, we recommend reporting visible transport damage within 48 hours where possible.

This request does not limit or replace any statutory consumer rights.

Where The Dragon Oak is legally responsible for loss, damage, incorrect delivery or non-conformity, an appropriate remedy will be provided in accordance with applicable law.

16. Statutory Legal Guarantee

Consumers benefit from the statutory legal guarantee of conformity provided by Belgian consumer law.

For new consumer goods, the statutory conformity guarantee generally applies for two years from delivery.

The statutory guarantee covers qualifying cases where a product does not conform to the sales agreement.

Available remedies are determined by applicable law and may include repair, replacement, an appropriate price reduction or termination of the contract where the legal conditions are met.

The statutory guarantee exists independently of any additional commercial guarantee and cannot be restricted by these Terms.

Natural characteristics or variations that were clearly disclosed before purchase are not automatically considered conformity defects.

17. Exchanges

The Dragon Oak may offer exchanges where practical.

An exchange is not required in order to exercise a statutory right of withdrawal.

Please contact us before returning an item if you would prefer an exchange.

Availability of a replacement product cannot be guaranteed, particularly for unique crystals, one of a kind pieces, limited collections or handmade products.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability or statutory consumer rights where such exclusion or limitation is prohibited by law.

To the extent permitted by law, The Dragon Oak is not responsible for damage resulting from use of a product contrary to its instructions, foreseeable purpose, warnings or reasonable safety precautions.

Spiritual or metaphysical results cannot be guaranteed.

19. Intellectual Property

The Dragon Oak name, branding, logos, product photography, original artwork, label designs, website text, graphics and other original creative website content are protected by applicable intellectual property law.

Purchasing a product does not transfer ownership of intellectual property rights associated with The Dragon Oak branding, artwork, photographs, written content or original designs.

Website content may not be copied, reproduced, commercially distributed or used to create misleading imitations without permission where such use is protected by law.

20. Privacy

Personal information is processed in accordance with our Privacy Policy and applicable data protection legislation.

Please consult our Privacy Policy for further information about how personal data is collected, used and protected.

21. Governing Law

These Terms and Conditions are governed by Belgian law.

Where the customer is a consumer, this choice of law does not deprive the customer of mandatory consumer protection granted by the law that would otherwise apply under applicable European Union rules.

Nothing in these Terms restricts a consumer's right to use any legally available dispute resolution or consumer protection procedure.

22. French Extended Producer Responsibility

For products placed on the French market, The Dragon Oak is registered with CITEO under the French Extended Producer Responsibility scheme for Household Packaging and Graphic Paper.

23. Changes to These Terms

The Dragon Oak may update these Terms and Conditions from time to time, including to reflect changes in law, business operations or services.

The Terms applicable to an order are those applicable at the time the order is placed, except where mandatory law requires otherwise.
